San Antonio police have not dropped charges against two Texas Longhorns football players despite a report from one of the player's attorney.

Jordan Hicks and Case McCoy are being investigated in a sexual assault case stemming from an incident that is alleged to have occurred on Dec. 28 in San Antonio. The Austin American-Statesman reported on Wednesday that Hicks' attorney, Perry Minton, said on Tuesday that the charges had been dropped and the case was closed.

"I just got off the phone with the police a few minutes ago," Minton told the newspaper. "Jordan's family is very pleased, and he's ready to get back to school and get back to football."

But on Wednesday afternoon, a San Antonio Police Department spokesman told the American-Statesman that the case has not been closed.

"In light of the media inquiries into the allegation of a sexual assault that took place in the early morning hours of December 28, 2012, in the downtown area, the San Antonio Police Department's SVU (Special Victims Unit) is still reviewing the case."

Hicks and McCoy were suspended for the Alamo Bowl but Minton told the newspaper the two had done nothing wrong after meeting a woman at a club and going back to her hotel room.

"I've talked to more witnesses in that bar than you can shake a stick at, and there never was any indication to me or anybody else that Jordan Hicks or Case McCoy did anything inappropriate," Minton said.
