Police: No charges for gunman in deadly apartment shooting
The man who shot and killed another man at Kelly Park Apartments will not face charges, police said. But a friend of the man killed was arrested.
Marcus Nunes, 24, of Havelock, was arrested Tuesday morning without incident, on charges of conspiracy to commit assault with a deadly weapon inflicting serious injury and breaking and entering. He was scheduled to appear in court Friday.
Nunes and 28-year-old Demetri Berry were holding a baseball bat and golf club, when they allegedly chased after 19-year-old Marvin Norris, Jr. at the Kelly Park Apartments in Havelock on Saturday, police said. Nunes and Berry allegedly believed Norris had broken into their home weeks ago.
Norris fled into an apartment of a family member, police said. But when Nunes and Berry broke down the door, Norris shot Berry, who later died at a hospital.
Norris will not be charged because he was defending himself, police said.
Havelock Police are investigating a Saturday morning shooting that killed one person. Late Monday afternoon, police identified the victim as Demetri Shavar Berry, 28, of Havelock.
Investigators were called shortly before 10:30 a.m. Saturday to Kelly Park Apartments on Shipman Road, according to a police spokeswoman. Upon arrival, officers found Berry with what appeared to be a single gunshot wound to the lower chest/upper abdomen area. He was lying at the foot of the steps in the first floor foyer area of the building. Berry was given immediate aid at the scene and was subsequently airlifted to Carolina East Medical Center in New Bern for treatment. A police spokesperson says Berry later died as a result of the internal trauma caused by the bullet inside his body.
Police were on scene at the complex again as of 11:30 a.m. Monday. They surrounded a residence there. So far, one person has been taken out of an apartment by police for questioning. Witnesses on scene tell us this is not the shooter.
